Medicolegal Problems in Lumbar Disc Herniation Surgery

According to the literature, the operation success rate is about 80-90% despite all the developments in radiologic imaging, surgical technique and experience. On the other hand, this success rate is markedly decreased in the case of recurrence or residual lesions. This is a real problem for neurosurgery specialists both for scientific and medicolegal reasons. Especially in the last 20 years, many physicians and especially neurosurgeons have been faced with legal problems because of the gradually increasing number of malpractice lawsuits against them. In this article, the medicolegal issues that can be encountered during lumbar herniated disc procedures are discussed in the light of the medical and judicial literature.
